Terms of Service

By accessing or using ToiletNearest.com - whether as a visitor, contributor, or developer integrating our API - you agree to these terms. Please read them before using the service. If you do not agree, you must stop using the service.

These terms apply to the website at toiletnearest.com, any mobile-optimised version of it, and the public API endpoint at toiletnearest.com/api. If you are using the service on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms.

1. The service

ToiletNearest.com provides a free, publicly available directory of public toilet locations. Data is sourced primarily from OpenStreetMap, supplemented by government open-data programmes and community submissions. The service is provided 'as is' without warranty of any kind.

We make no guarantee about the accuracy, completeness, currency, or fitness for any particular purpose of the information displayed on the website. Toilet facilities change frequently - they close for maintenance, change their opening hours, change their costs, are demolished, or are built new faster than any database can perfectly track.

Always verify that a facility is open and suitable for your needs before making a journey based solely on information from this site. This is especially important for wheelchair accessible toilets and facilities needed for medical reasons, where an incorrect entry could have serious consequences.

2. Acceptable use

ToiletNearest.com is provided as a public utility. You may use it for personal, non-commercial purposes including travel planning, accessibility research, and finding nearby facilities.

You must not:

Scrape, bulk-download, or systematically copy toilet data without our written permission
Use the service to build a derivative commercial database without attribution and a licence agreement
Circumvent, bypass, or disable any rate limits, access controls, or technical protections on the API
Submit false, misleading, or malicious toilet data - including locations that do not exist, deliberately wrong accessibility information, or spam entries
Use automated tools to submit large numbers of low-quality or duplicate entries to the database
Attempt to gain unauthorised access to any part of our systems, databases, or infrastructure
Use the service in any way that violates applicable law, including privacy law, anti-spam legislation, or consumer protection rules

Breach of these conditions may result in suspension of your access and, for serious or persistent violations, legal action.

3. Data attribution

A significant portion of the toilet location data shown on ToiletNearest.com originates from OpenStreetMap. OpenStreetMap data is © OpenStreetMap contributors, made available under the Open Database Licence (ODbL).

If you use any data from ToiletNearest.com in a public product, publication, application, or service - even if accessed via our API - you must attribute both ToiletNearest.com and OpenStreetMap. The required attribution text is:

Government datasets integrated into our database carry their own licences. The UK Open Government Licence v3, Australia's Creative Commons Attribution licence, and similar licences require attribution in derived works. We will supply the specific attribution requirements for any dataset on request.

4. User submissions

When you submit a toilet report, add a new location, verify an existing entry, or leave a review through ToiletNearest.com, you grant us a worldwide, perpetual, royalty-free, non-exclusive licence to use, display, modify, and incorporate that submission for the purposes of operating the service and improving the database.

You retain ownership of the content you submit. You are responsible for the accuracy of what you submit. By submitting, you confirm that you are not violating any third-party rights, that the information is accurate to the best of your knowledge, and that you have permission to submit any photographs attached to the report.

We reserve the right to edit, correct, or remove any submission that we determine in our sole discretion is inaccurate, malicious, offensive, or otherwise inappropriate. Submissions that violate these terms may result in your access being restricted.

5. API access

The public API endpoint (/api/toilets) is available without authentication for non-commercial use, subject to the rate limits set out in the API documentation. The current public rate limit is 10 requests per minute per IP address.

If you are developing a non-commercial application and need higher rate limits, apply for a developer API key through the API documentation page. Developer keys are granted at our discretion and require you to describe your project and intended use.

For commercial integration - including embedding toilet data in a paid product, using the API to power a revenue-generating service, or bulk data export for business purposes - written permission from ToiletNearest.com is required before you begin. 6. Intellectual property

The ToiletNearest.com brand, logo, website design, user interface, original editorial content (guides, blog posts, page copy), and the arrangement and presentation of data are owned by ToiletNearest.com and protected by copyright law.

Toilet location data is licensed from OpenStreetMap contributors under ODbL, and from government open-data programmes under their respective licences. None of this data is exclusively owned by ToiletNearest.com - we are redistributing it under the terms of its original licence, with additions from community contributions licensed back to us under the terms of Section 4.

7. Disclaimers and liability

To the maximum extent permitted by applicable law, ToiletNearest.com is provided 'as is' and 'as available' without any warranty, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that the information will be accurate, complete, or current.

We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, or from reliance on information provided. This includes but is not limited to situations where a listed toilet is closed, inaccessible, unsafe, or does not exist.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.

8. Termination

We may terminate or restrict your access to the service at any time without notice if we believe you have breached these terms, are abusing the service, or are acting in a way that could harm other users or the integrity of the data. Where termination affects API access, we will attempt to provide reasonable notice unless the breach is severe or ongoing.

9. Governing law and disputes

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the service shall first be subject to good-faith negotiation. If a dispute cannot be resolved informally within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the EEA, you may also have rights under the laws of your country of residence that cannot be excluded by choice of law.

10. Changes to these terms

We may update these terms as the service evolves, as legal requirements change, or as we add new features. The 'Last updated' date at the top reflects when this version was published. Continued use of the service after the updated terms are posted constitutes acceptance of the new terms. For significant changes, we will post a notice on the homepage.
